We at Glam and Glow BBS understand that you entrust your data to us.  In this Policy we inform you of our policies regarding the collection, use, and disclosure of Personal Information (defined below) we receive from users of the Site.  We describe the practices we follow to respect the privacy of all users of the Site.

When you visit our Site we collect and processes personal data relating to you including contact information, shopping cart registrations, and transaction information (“Personal Information”).  This information is either automatically collected or is customer initiated.

If Glam and Glow Beauty and Body Services is sold to or otherwise acquired by a third party, all Glam and Glow Beauty and Body Services data assets will become the property of the acquiring party.  Such a party will be subject to any consent(s), opt-outs or other customer conditions on data.  A change in data ownership may or may not include a notice on the Site.

Limitation of Liability

The following provisions set out Glam and Glow BBS’s entire financial liability (including any liability for the acts or omissions of Glam and Glow Beauty and Body Services and our suppliers, subsidiaries, affiliates, officers, agents, partners, members, managers and employees) to you in respect of: (a) any breach of these Terms of Use; (b) your use of the Site or the Services or inability to use the Site or the Services; and (c) any representation, misrepresentation (whether innocent or negligent), statement or tortious act or omission (including negligence) arising out of or in connection with these Terms of Use.

All warranties, conditions, and other terms implied by statute or common law are excluded from these Terms of Use to the fullest extent permitted by law.

Glam and Glow Beauty and Body Services shall not be liable, whether in contract, misrepresentation (whether innocent or negligent), tort (including negligence) or otherwise, for:

§  loss of profits;

§  loss of business;

§  depletion of goodwill or similar losses;

§  loss of anticipated savings;

§  loss of goods;

§  loss of contract;

§  loss of use;

§  loss or corruption of data or information; or

§  any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses, whether the same are suffered by you or any person claiming under or through you and whether the same are suffered directly or indirectly.

Our total liability in contract, misrepresentation (whether innocent or negligent), tort (including negligence) or otherwise, arising in connection with the performance or contemplated performance of these Terms of Use shall be limited to any amount paid by you to Glam and Glow Beauty and Body Services in the previous twelve (12) month period.

Exclusions and Limitations

Indemnification

You agree to indemnify and hold Glam and Glow BBS, and our suppliers, subsidiaries, affiliates, officers, agents, partners, members, managers and employees, harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of any content or information you submit, or transmit through the Site or Services, your violation of these Terms of Use, or your violation of any rights of another.

Ending the Contract

You agree that Glam and Glow BBS, in its sole discretion, may terminate your account and use of the Site and the Services, for any reason, including for lack of use or if we believe that you have violated or acted inconsistently with these Terms of Use.  Any suspected fraudulent, abusive, or illegal activity that may be grounds for termination may be referred to appropriate law enforcement authorities.

You agree that any termination of your access to the Site or the Services under any provision of these Terms of Use may be effected without prior notice, and acknowledge and agree that we may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Services, subject to compliance with local laws.

You agree that we shall not be liable to you or any third-party for any termination of your access to the Services.

Proprietary Rights

You acknowledge and agree that the Site and the Services and any necessary software used in connection with the Site and/or Services (“Software”) may contain proprietary and confidential information that is protected by applicable intellectual property and other laws.

Except as expressly authorized by Glam and Glow BBS, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Site, Services, or the Software, in whole or in part.  Software, if any, that is made available to download from the Site or Services, excluding software that may be made available by end-users through the website, is the copyrighted work of Glam and Glow Beauty and Body Services or our suppliers.  Your use of the Software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Software (“License Agreement”).  You may not install or use any Software that is accompanied by or includes a License Agreement unless you first agree to the License Agreement terms.

For any Software not accompanied by a License Agreement, Glam and Glow Beauty and Body Services grants you a personal, non-transferable and non-exclusive right and license to use the object code of that Software on a single computer; provided that you do not (and do not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the Software.  You agree not to modify the Software in any manner or form, or to use modified versions of the Software, including for the purpose of obtaining unauthorized access to the Glam and Glow Beauty and Body Services shopping cart.  You agree not to access the Glam and Glow Beauty and Body Services shopping cart by any means other than through the interface that is provided by Glam and Glow Beauty and Body Services for use in accessing the Glam and Glow Beauty and Body Services shopping cart.

Notices

Glam and Glow Beauty and Body Services will send any notice to you under these Terms of Use to the email address you use to contact Glam and Glow BBS.

You agree to send any notice under these Terms of Use to Glam and Glow Beauty and Body Services to glambyashleymua@gmail.com.

Privacy Policy

Glam and Glow Beauty and Body Services shall process any personal data it may receive from you on the Site in the course of performing the Services, in accordance with the Privacy Policy.  You hereby consent to the processing of your personal data in accordance with the Privacy Policy .

Entire Agreement

These Terms of Use and the Privacy Policy (the “Agreement”) sets out the entire agreement between you and Glam and Glow Beauty and Body Services and supersede and discharge all liability arising from any previous agreements (whether oral or in writing), discussions, negotiations and understandings between us relating to those matters.

You agree that in entering into the Agreement, you have not relied on, and shall have no remedies with respect to any express or implied warranty or representation (including any negligent misrepresentation) made by Glam and Glow Beauty and Body Services that is not expressly set out in the Agreement.

Nothing in the Agreement is intended to exclude or limit our liability for fraud or fraudulent misrepresentation.

Applicable Law and Other Miscellaneous Legal Information

The Skincare products are created by Skin Script in Arizona.  As such, the laws of the Arizona will govern these Terms of Use, without giving effect to any principles of conflicts of laws.

Any claim or dispute between you and Skin Script that arises in whole or in part from the Skincare products shall be decided exclusively by a court of competent jurisdiction located in the Arizona.  If any provision of these Terms of Use is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect.  No waiver of any term of these Terms of Use shall be deemed a further or continuing waiver of such term or any other term, and Skin Script’s failure to assert any right or provision under these Terms of Use shall not constitute a waiver of such right or provision.  It is the express wish of the parties that these Terms of Use and all related documents be drawn up in English.  TO THE EXTENT PERMITTED BY APPLICABLE LAWS, YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SKINCARE PRODUCTS MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES.  OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
